The Bank of South Sudan is empowered by the Bank of South Sudan Act, 2011, and other relevant legislation to issue regulations and circulars. These can address various purposes:
- Clarifying existing laws: The Bank can publish circulars explaining or clarifying existing laws and regulations for financial institutions (like banks) to ensure they comply effectively.
- Policy guidance: The Bank can establish policy guidelines outlining how it intends to exercise its functions under the Act. These guidelines may also specify how regulated entities should conduct business to meet those expectations.
- Prudential guidelines: The Bank can issue guidelines identifying business practices that could harm the financial stability of individual institutions or the entire financial system. These practices should be avoided by regulated entities.
To ensure transparency, the Bank maintains a public register of all regulations and circulars it issues.
